Warranty

All Bauen Products are backed by standard limited warranty outlined below.

Conditions that must be met:

Must be purchased directly from Bauen. We do not work with third-party retailers or resellers.
Original purchaser or recipient of gift, which was purchased directly from Bauen. Proof of date of purchase is required.
Non transferable; only valid as long as owned by original purchaser or gift recipient
Product must be returned to Bauen for evaluation and approval
Must have used the Product only as intended per the Product's care instructions

What it covers:

For three years from date of purchase, if a defect occurs as the result of the Product's intended use during the Warranty Period, we will repair or replace, at our discretion, the defective product or part.

What it does not cover:

Our Products are designed for home use and therefore Warranty is void if used in a commercial setting (including but not limited to hospitality, daycare, school, playground, etc).

Normal wear and tear, including but not limited to scratches, stains, scuffs, dents, or other changes in the cosmetic appearance of the Product that does not affect its functionality
Natural breakdown of colors over extended time and use
Defects or damage from third-party modifications, repairs, or replacement parts
Abuse, accidents, vandalism or other non-manufacturer defects

Discontinued items:

We will make every effort to replace limited edition or discontinued Products but cannot guarantee their availability for replacement. Any limited edition or discontinued Product still under its applicable warranty that cannot be replaced with an identical product will be replaced with a similar or equivalent model or color based on availability.

Warranty Terms

The Site is provided "as is" and without warranty of any kind. Bauen's Product warranty is as set forth above.

Warranty Disclaimer and Limitation of Liability

EXCEPT AS EXPRESSLY PROVIDED IN THESE TERMS OR OTHERWISE AGREED UPON IN WRITING BY BAUEN, BAUEN HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS RELATED TO THE SITE OR THE PRODUCTS, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BAUEN OR ITS SUPPLIERS BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE, CONSEQUENTIAL OR OTHER DAMAGES WHATSOEVER ARISING OUT OF OR IN ANY WAY RELATED TO THE USE OF OR INABILITY TO USE THE SITE OR THE PURCHASE OF PRODUCTS, EVEN IN THE EVENT OF THE FAULT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, BREACH OF CONTRACT OR BREACH OF WARRANTY OF BAUEN OR ANY SUPPLIER, AND EVEN IF BAUEN OR ANY SUPPLIER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL BAUEN'S AGGREGATE LIABILITY TO YOU EXCEED THE DOLLAR AMOUNT OF PURCHASES MADE BY YOU IN THE PREVIOUS ONE-MONTH PERIOD. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.

Legal

These Terms shall be governed by the laws of the State of Connecticut without reference to its conflicts of laws principles. You agree that any action at law or in equity arising out of or relating to these Terms may be brought only in the state courts located in Connecticut and you hereby consent and submit to the personal jurisdiction of such courts. Bauen may modify these Terms from time to time by posting them to the Site and such modified Terms shall be effective upon posting, except that any disputed between you and Bauen will be governed by the version of the Terms in effect as of the date the dispute arose. Bauen may modify pricing and products at any time for any reason by posting changes to the Site. You agree to indemnify, defend and hold Bauen and its officers, directors, employees, agents, licensors, and suppliers harmless from and against all claims, liabilities, losses, expenses, damages and costs, including reasonable attorneys' fees and costs of experts, resulting from your violation or breach of these Terms.
